Target market determinations
The Tycoon Real Income Fund is the only retail product offered by this website and requires a target market determination (TMD) under Part 7.8A of the Corporations Act 2001 (Cth). TY Capital’s other products, including the Tycoon Core Income Fund, are offered to wholesale clients only and are not required to have a TMD on that basis; this position will be reassessed if the investor base or offer structure of any product changes.
Target returns
Every return figure published on this site is a target. Targets are not forecasts, are not guaranteed, and a fund may not meet them. The relevant Product Disclosure Statement or Information Memorandum sets out how each target is calculated and the assumptions behind it.
Conflicts of interest
The trustee and manager of the Tycoon Core Income Fund may receive loan establishment, variation and discharge fees from borrowers. These fees are retained and are not paid to the fund. This is disclosed in the Information Memorandum.
Investor classification
Interests in TY Capital’s wholesale-only products are offered only to investors who qualify as “wholesale clients” under section 761G of the Corporations Act 2001 (Cth) and the relevant section under regulations 7.1.18 and 7.1.19 of the Corporations Regulations 2001 (Cth). Before accepting an application, TY Capital verifies wholesale status against one of the following:
Accountant’s certificate — a certificate or certified letter from a qualified accountant explicitly for the purpose of making investment in a specifically named product or service or, upon approval of the manager of the relevant product or service, dated within the preceding 12 months, confirming the investor holds net assets of at least $2.5 million, or gross income of at least $250,000 in each of the preceding two financial years.
Professional investor — evidence that the investor holds an Australian financial services licence (AFSL number provided), or otherwise meets the “professional investor” definition in section 9 of the Corporations Act (for example, a listed entity, bank, or other regulated financial institution).
Investment size — a subscription of at least $500,000 for a single investment in the relevant product.
TY Capital retains the supporting evidence relied on for each investor’s classification and will request updated evidence where a certificate has expired or circumstances indicate the investor may no longer qualify.
