About these Terms
These are the terms on which TY Capital Group Pty Ltd (ACN 647 012 593, AFSL 528626) (“TY Capital”, “we”, “us”, “our”) permits you to access and use this website (the “Site”). They apply to every visitor, and to any information, tools or services made available on the Site.
Acceptance
By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Site.
Who this Site is for
The Site is intended for use by persons located in Australia. It is not intended for distribution to, or use by, any person in any jurisdiction where such distribution or use would be contrary to local law or regulation, and is not directed at persons in the United States. Products referred to on the Site are available only to the class of investor stated for that product, and only where lawful to offer them to that person.

It is not financial product advice, an offer to issue or sell a financial product, or a recommendation, and it does not take into account your objectives, financial situation or needs. Retail and wholesale products
The Tycoon Real Income Fund is a registered managed investment scheme available to retail investors under a Product Disclosure Statement. Interests in the Tycoon Real Income Fund are issued by Primary Securities Ltd (ABN 96 089 812 635), as Responsible Entity of the fund and holder of Australian Financial Services Licence Number 224107. TYCG Fund Alpha Pty Ltd (ACN 661 135 986) is appointed by Primary Securities Ltd as manager under a fund management agreement, and is an appointed Authorised Representative (CAR No. 1314195) of Primary Securities Ltd. The Tycoon Real Income Fund is not operated under TY Capital’s or its own Australian Financial Services Licence.
The Tycoon Core Income Fund and the Individual Managed Account service are available only to wholesale clients under section 761G of the Corporations Act 2001 (Cth), and only under the relevant Information Memorandum.
No guarantee of returns
Target returns are targets only. They are not forecasts and they are not guaranteed. Investments are not bank deposits, are not guaranteed, and you can lose some or all of the money you invest. Past performance is not a reliable indicator of future performance.
Intellectual property
The Site and its content, including text, graphics, logos, design, software and the compilation of that content, are owned by, or licensed to, TY Capital, and are protected by Australian copyright, trade mark and other intellectual property laws. “TY Capital,” “Tycoon Real Income Fund,” “Tycoon Core Income Fund” and associated logos are trade marks of TY Capital or its related entities, unless otherwise indicated.
You may view, print or download content from the Site for your own personal, non-commercial use only. You must not reproduce, republish, modify, distribute, transmit, sell or create derivative works from any part of the Site without our prior written consent, and any such permitted copy must retain all copyright and other proprietary notices.

Limitation of liability
To the maximum extent permitted by law, and subject to any rights you have under the Australian Consumer Law (as set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or the ASIC Act 2001 (Cth) that cannot be excluded, restricted or modified (“Non-Excludable Rights”):
(a) TY Capital and their respective directors, officers, employees and agents exclude all liability (whether in contract, tort, including negligence, or otherwise) for any loss, damage, cost or expense (including indirect or consequential loss) arising out of or in connection with your use of, or inability to use, the Site;
(b) where liability cannot lawfully be excluded but can be limited, our liability is limited, at our option, to the resupply of the relevant service or the cost of having the service resupplied; and
(c) nothing in these Terms excludes, restricts or modifies any Non-Excludable Right, or any right or remedy conferred on you by the Corporations Act 2001 (Cth) in respect of a financial product or financial service.
Changes to these Terms
We may amend these Terms at any time by updating this page. The updated Terms take effect from the date of posting, and your continued use of the Site after that date constitutes acceptance of the amended Terms. We recommend you review this page periodically.
Governing law
These terms are governed by the laws of New South Wales, Australia.
